MuscleFight Terms of Service

These terms are the agreement between you and Strengthnet Studios LLC, which trades as MuscleFight ("we", "us"), for using musclefight.com, your account at users.musclefight.com, and the videos you buy from us. Please read them before you buy. By creating an account or making a purchase, you agree to them. Our Refund Policy and Privacy Notice form part of these terms.

1. Who can use MuscleFight

You must be 18 or older to create an account or buy videos. By using MuscleFight you confirm that you are, and that you can form a binding contract where you live.

2. Your account

You can create an account yourself, or one is created for you when you first buy, using the email address you give at checkout. In that case we email you a link to get in, and you can then set a password.
Keep your password to yourself. You are responsible for what happens under your account, so tell us straight away at support@musclefight.com if you think someone else has used it.
An account is for one person. Don't share it or sell it.
Keep your email address up to date. It's where your order confirmations and download links go.

3. Buying videos

Prices are shown in US dollars. If tax applies to your purchase, it is shown before you pay.
Payment is taken by Stripe, our payment provider, when you complete checkout. Your purchase is confirmed when Stripe confirms the payment, and we then email you an order confirmation.
Discounts and promo codes apply only as described and only while the offer is running, and they can't be exchanged for cash. Some offers combine with others and some don't; the price shown in your cart before you pay is the price you pay.
Quality: a 4K purchase includes the 1080p version of the same video.
Mistakes: if a video is listed at an obviously wrong price, we may cancel the order and refund you in full, even after you've paid.
Immediate access: at checkout you ask us to make your videos available straight away. If you are in the European Union, the United Kingdom or another country with a legal right to cancel online purchases, you agree that you lose that right once you start downloading. You still have the rights described in our Refund Policy.

4. What you may do with the videos you buy

The videos, trailers, images, athlete profiles and everything else on MuscleFight belong to us or to the people who licensed them to us, and are protected by copyright and other laws.

When you buy a video, we give you a personal licence to download it and watch it, for your own private, non-commercial viewing, on devices you own or control. You may keep and watch the copies you download for as long as you like, but the licence can't be transferred to anyone else. You are buying the right to watch, not the video itself.

You may not:

share, upload, stream, post, sell, rent, lend or give away the video or any part of it, including clips, stills and GIFs;
show it in public or charge anyone to watch it;
edit it, remove any watermark or notice, or use it to make something new;
use it, or anything else on MuscleFight, to train or feed an artificial intelligence system; or
let anyone else download it using your account.

If you break these rules, the licence ends automatically. We may also close your account and take any action the law allows.

5. Downloads

You have 30 days from your purchase to download your videos. After that, the download buttons disappear from your account. Save a copy of every video you buy.
Each download link works for a short time, and there is a limit on how many links you can create for each video. While the 30 days last, you can create a new link from your account.
If you need to download a video again after the 30 days, or you've reached the limit, email support@musclefight.com and we can send you a new download link.
If we have to remove a video before you've downloaded it, we'll refund it.

6. Refunds and chargebacks

Refunds are covered by our Refund Policy.

If you dispute a payment with your bank or card company (a "chargeback") instead of contacting us, access to every video in that order ends when the dispute is opened. If the dispute is later decided in our favour, contact us and we'll restore your access. Please talk to us first; most problems can be fixed quickly.

7. Reviews

Only customers who have access to a video, because they bought it or we gave it to them, can review it. By submitting a review, you:

confirm it's your honest opinion and doesn't break the rules in section 8;
agree that it can be shown publicly on MuscleFight under the display name you choose; and
give us a free, worldwide, non-exclusive, permanent licence to display, reproduce and share it, in full or in part, on MuscleFight and in our marketing, with or without your display name.

We check reviews before publishing them. We may decline or remove any review, including one that isn't about the video, reveals someone's personal information, or is abusive.

8. Rules for using MuscleFight

You agree not to:

break the law, or help anyone else to;
post anything abusive, hateful, threatening, defamatory or obscene, or anything that infringes someone else's rights;
impersonate anyone, or give false information when you buy;
try to get around download limits, payment, security or access controls;
copy, scrape or harvest content or data from the site, by automated means or otherwise; or
interfere with the site, overload it, or try to access parts of it that aren't meant for you.

9. About our videos

Our videos show adult athletes in physical competition. Many matches are staged, professional-wrestling-style entertainment. Don't try to copy what you see. The athletes are trained, and the matches are filmed under controlled conditions. Athlete statistics such as height, weight and measurements are provided for entertainment and may not be exact.

10. Copyright complaints

If you believe something on MuscleFight infringes your copyright, email support@musclefight.com with:

your contact details;
a description of the work you believe is being infringed, and where it appears on MuscleFight;
a statement that you believe in good faith the use isn't authorised; and
a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorised to act for the owner, with your signature.

If you find MuscleFight videos shared anywhere without our permission, we'd be grateful if you told us.

11. Emails and notifications

We send emails about your orders and account; these aren't optional while you have an account. Our newsletter and browser notifications are optional, sent only if you ask for them, and you can turn them off at any time.

12. Our responsibility to you

We work hard to keep MuscleFight running and your videos available, but the site is provided "as is" and "as available". To the fullest extent the law allows, we don't promise that it will always be available, uninterrupted or free of errors, or that every video will play on every device.

To the fullest extent the law allows:

we are not liable for indirect or consequential losses, such as lost data, lost profits or damage to your devices, that were not reasonably foreseeable; and
our total liability to you for anything arising out of these terms or MuscleFight is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms limits any liability that the law does not allow us to limit, or takes away rights you have as a consumer under the law of the country where you live.

13. Your responsibility to us

If you break these terms and that causes a claim against us, for example by sharing videos you bought, you agree to cover our reasonable costs of dealing with it, including legal fees.

14. Suspending or closing accounts

We may suspend or close your account if you break these terms, if we must by law, or to protect MuscleFight or other customers. If we close your account for any other reason, we'll give you notice so you can download your videos first, unless the law prevents us. You can close your account at any time by emailing support@musclefight.com.

15. Changes to these terms

We may update these terms, for example when we add features or the law changes. If we do, we'll update the date at the top, and for significant changes we'll tell you by email or on the site before they take effect. The version in force when you bought a video applies to that purchase.

16. Law and disputes

These terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law rules. Any dispute will be decided by the courts in Miami-Dade County, Florida, although either of us may use small claims court where it qualifies.

If you live outside the United States, you keep any mandatory consumer protections of your own country, and you may bring a claim in its courts where its law allows.

Please contact us first, at support@musclefight.com; most problems can be solved without a formal dispute.

17. General

If any part of these terms can't be enforced, the rest still applies.
If we don't enforce a term straight away, we can still enforce it later.
We may transfer our rights and obligations under these terms to another company, for example if MuscleFight is sold. Your rights under these terms won't be reduced as a result.
These terms, with the Refund Policy and Privacy Notice, are the whole agreement between us about MuscleFight.
